Returns and Refunds

 

If the items delivered are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 14 working days of the delivery of the items in question.

If you do not receive items ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at [email protected] of the problem within 37 days of the date on which you ordered the items.

If you notify a problem to us under this condition, our only obligation will be, at your option:

  • to make good any shortage or non-delivery;
  • to replace or repair any items that are damaged or defective; or
  • to refund to you the amount paid by you for the items in question in whatever way we choose.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the items in question.

Once you have received your purchase, please check the item carefully before removing the security tag or destroying the packaging. We are unable to accept any returned products if they have been worn, if the security tag is unattached or if the original packaging is destroyed.

If you do wish to return an item in the event that there is a problem with the item (damaged defective or the delivery is of an incorrect quantity) or you simply want to cancel the order, please email [email protected] within seven days of receipt of the item (commencing on the day after the product is received by you) outlining the reason that you wish to return the item.

Remember we will only accept a returned item if the item is unworn, in a fully re-saleable condition with the security tag attached and the item is enclosed in its original packaging.

Martin & Co reserves the right to refuse a refund on the item if the above conditions are not met. This does not affect your statutory rights.

Please ensure that you use a delivery service where the value of the items are fully insured as Martin & Co is not liable for items that are damaged or mislaid in transit. You are liable for the cost of the return of the items to us unless stated otherwise in this Returns Policy. In the event that you cancel your order after receipt of the items by you and we are required to pay for the delivery cost of the return of the items to us, we will be entitled to recover the delivery cost from you. The delivery costs will be deducted from the amount to be refunded to you or charged to the card which you used to pay for the items.

Once your return has been received and processed, Martin & Co will email you and refund the price of the item, less any delivery charges, to the original purchaser’s credit card as stated in the order, within 30 days of receipt of your notice of cancellation or exchange the item or issue a Martin & Co credit note.

Please note that card refunds can take up to 10 working days for your bank to complete.

If you do not request to return the item within seven working days of receiving your purchase and do not return the item within 14 days of receiving our acknowledgement email, or in the event of non-delivery, fail to contact us within 37 days of placement of your order, then any items you may wish to return will be at the discretion of Martin & Co and in the event, we decide to issue you with a refund, we will be entitled to provide this by way of a Martin & Co credit note only.

This Returns and Refunds Policy is governed by the laws of England and Wales and you and Martin & Co agree to submit to the exclusive jurisdiction of the courts of England.
